1. Acceptance of Terms

By registering for an account, clicking "I Agree," or otherwise accessing or using the Platform, you expressly acknowledge that you have read, understood, and agree to be bound by this Agreement, our Privacy Policy, and all applicable laws and regulations.

If you are accepting these terms on behalf of an institution, school, university, or other organization, you represent and warrant that you have the authority to bind that organization to this Agreement.

2. Definitions

For the purposes of this Agreement, the following terms shall have the meanings set forth below:

• "Platform" refers to the Own Education Own Career, including all software, interfaces, APIs, documentation, and associated services.
• "Institution" means any school, college, university, coaching centre, or educational body that has subscribed to the Platform on behalf of its staff and students.
• "Administrator" means a User designated by an Institution to manage the Platform settings, user accounts, and data within that Institution's account.
• "Student" means an enrolled learner who uses the Platform for educational activities including assignments, assessments, and course content.
• "Content" means all text, images, audio, video, assessments, course materials, data, and other materials uploaded to or generated through the Platform.
• "Personal Data" shall have the meaning ascribed under the Digital Personal Data Protection Act, 2023 (India) and applicable data protection regulations.

3. Eligibility & Access

Access to and use of the Platform is subject to the following eligibility requirements:

• Institutional accounts must be registered by an authorized representative with capacity to enter into binding agreements.
• Access is restricted to registered Users only. Sharing credentials or granting unauthorized access is strictly prohibited.
• Own Education Own Career reserves the right to verify eligibility at any time and deny or revoke access without notice if eligibility requirements are not met.

4. User Accounts & Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

• Provide accurate, current, and complete information during registration and keep it updated.
• Immediately notify Own Education Own Career at oeoc.care@gmail.com of any unauthorized use or suspected breach of your account.
• Use a strong, unique password and enable multi-factor authentication where available.
• Not share your login credentials with any third party, including other Users of the Platform.
• Log out of your account at the end of each session, particularly when using shared devices.

Own Education Own Career shall not be liable for any loss or damage arising from your failure to comply with these account security obligations.

5. Permitted Use & Prohibited Conduct

The Platform is provided exclusively for lawful educational and administrative purposes. You may use the Platform to manage academic records, deliver course content, facilitate assessments, communicate with students and staff, and generate institutional reports.

The following conduct is strictly prohibited:

• Uploading, distributing, or transmitting any content that is unlawful, defamatory, obscene, hateful, or otherwise objectionable.
• Engaging in any form of academic dishonesty, including plagiarism, unauthorized sharing of examination materials, or impersonation.
• Attempting to gain unauthorized access to other Users' accounts, data, or restricted areas of the Platform.
• Using automated tools, bots, scrapers, or scripts to access or extract data from the Platform without prior written consent.
• Reverse-engineering, decompiling, or disassembling any software component of the Platform.
• Selling, reselling, sublicensing, or commercializing the Platform or any Content without authorization.
• Transmitting malware, ransomware, spyware, or any other malicious code.
• Harassing, threatening, or discriminating against any User on the basis of caste, religion, gender, disability, or any other protected characteristic.

6. Intellectual Property

All intellectual property rights in and to the Platform, including but not limited to its software, design, interface, trademarks, logos, and proprietary methodologies, are owned by or licensed to Own Education Own Career. These rights are protected under the Copyright Act, 1957, the Trade Marks Act, 1999, the Patents Act, 1970, and all applicable international intellectual property laws.

Subject to your compliance with this Agreement, Own Education Own Career grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform solely for your permitted educational or administrative purposes.

Content uploaded by Users (including course materials, assessments, and institutional data) remains the intellectual property of the respective User or Institution. You grant Own Education Own Career a limited, royalty-free licence to host, process, and display such Content solely for the purpose of providing the Platform's services.

7. Data & Privacy

Own Education Own Career is committed to protecting the privacy and security of all Users. Our data practices are governed by our Privacy Policy, which is incorporated by reference into this Agreement.

• Personal Data collected through the Platform is processed in accordance with the Digital Personal Data Protection Act, 2023 (India) and applicable state regulations.
• Student data is treated as sensitive personal information and is subject to heightened protection measures, including encryption in transit and at rest.
• Own Education Own Career does not sell, rent, or disclose Personal Data to third parties for marketing purposes.
• Institutions act as Data Principals with respect to their students' data, and Own Education Own Career acts as a Data Fiduciary as defined under applicable law.
• Data retention periods and deletion procedures are detailed in our Privacy Policy and Data Retention Schedule.

8. User-Generated Content

You are solely responsible for all Content you upload, submit, post, or otherwise transmit through the Platform. By submitting Content, you represent and warrant that:

• You own or have obtained all necessary rights, licences, and permissions to submit the Content.
• The Content does not infringe the intellectual property, privacy, or other rights of any third party.
• The Content complies with all applicable laws, regulations, and this Agreement.
• The Content does not contain personally identifiable information of minors without appropriate consent.

Own Education Own Career reserves the right, but assumes no obligation, to monitor, review, and remove Content that violates this Agreement, at its sole discretion and without notice.

9. Fees & Payments

Access to certain features and modules of the Platform requires payment of subscription fees as set out in the applicable Subscription Order Form or pricing schedule. The following terms apply:

• All fees are stated in Indian Rupees (INR) unless otherwise specified and are exclusive of applicable taxes including Goods and Services Tax (GST).
• Subscription fees are billed in advance on an annual or monthly basis, as selected during registration.
• Payments are due within 30 days of invoice unless otherwise agreed in writing.
• All fees paid are non-refundable except as expressly stated in our Refund Policy or as required by applicable law.
• Own Education Own Career may revise pricing with 60 days' advance written notice to Administrators.

10. Suspension & Termination

Either party may terminate this Agreement in accordance with the following provisions:

• By You: You may terminate your account at any time by providing 30 days' written notice to Own Education Own Career. Upon termination, your access will be revoked, and your data will be retained for 90 days to facilitate export before deletion.
• By Own Education Own Career: It may suspend or terminate your account immediately upon written notice if you breach any provision of this Agreement, engage in fraudulent activity, or fail to pay applicable fees.
• Effect of Termination: Upon termination, all licences granted under this Agreement will immediately cease, and you must stop all use of the Platform.
• Data Export: You may request an export of your institutional data within 30 days of termination. After 90 days post-termination, Own Education Own Career will permanently delete all User data.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Own Education Own Career shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, data, goodwill, or academic records, arising from your use of or inability to use the Platform.

Own Education Own Career’s total aggregate liability to you for any claims arising under this Agreement shall not exceed the total fees paid by you in the twelve (12) months immediately preceding the event giving rise to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Own Education Own Career., its directors, officers, employees, agents, licensors, and service providers from and against all claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your violation of any provision of this Agreement.
• Your use or misuse of the Platform.
• Content you upload, submit, or transmit through the Platform.
• Your violation of any applicable law, regulation, or third-party right.
• Any claim that your Content caused damage to a third party.

13. Dispute Resolution & Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law provisions.

• Good Faith Negotiation: In the event of any dispute, controversy, or claim arising out of or relating to this Agreement, the parties shall first attempt to resolve the dispute through good-faith negotiation within 30 days of written notice.
• Mediation: If negotiation fails, the parties shall submit the dispute to mediation under the Mediation Act, 2023 before a mutually agreed mediator in Kolkata, West Bengal.
• Arbitration: If mediation is unsuccessful, the dispute shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by mutual agreement. The seat and venue of arbitration shall be Kolkata, and proceedings shall be conducted in English.
• Jurisdiction: For interim relief or enforcement of arbitral awards, the parties submit to the exclusive jurisdiction of the courts of Kolkata, West Bengal, India.

14. Amendments to These Terms

Own Education Own Career reserves the right to modify, update, or replace any part of this Agreement at any time. The following applies to amendments:

• Material changes will be communicated to registered Users via email and/or an in-Platform notification at least 30 days before the change takes effect.
• Non-material clarifications or corrections may be made without prior notice and will be effective upon posting.
• The "Effective Date" at the top of this document indicates when the current version became operative.
• Your continued use of the Platform after the effective date of any amendment constitutes your acceptance of the revised terms.
• Prior versions of this Agreement are archived and available upon request.

Return & Refund Policy

Own Education Own Career is committed to ensuring a fair and transparent return and refund process. This policy applies to all subscription plans, course purchases, and add-on services purchased through the Platform. Please read this section carefully before making any payment.

Subscription Plans

• Annual Subscriptions: A full refund will be issued if a cancellation request is received within 7 calendar days of the initial purchase date, provided the account has not been actively used (i.e., no courses accessed, no data uploaded, and no users invited).
• Monthly Subscriptions: Monthly plans are non-refundable once the billing cycle has commenced. You may cancel at any time to prevent future charges; cancellation takes effect at the end of the current billing period.
• Institutional Plans: Refund eligibility for institutional/enterprise plans is governed by the specific terms of the signed Subscription Order Form. Contact your account manager for details.
• Upgrades: Payments made to upgrade from a lower to a higher subscription tier are non-refundable. The upgrade takes effect immediately upon payment.

Individual Course Purchases

• Refunds for individually purchased courses are available within 14 calendar days of purchase, provided that less than 20% of the course content has been accessed or completed.
• Once more than 20% of course content has been consumed, no refund will be issued regardless of the reason
• Courses purchased as part of a bundle are non-refundable individually; the full bundle refund policy applies instead.
• If a course is removed from the Platform by Own Education Own Career after purchase and before completion, a pro-rata refund will be issued automatically to the original payment method within 10 business days.

Add-On Services & Features

• One-time add-on purchases (e.g., additional storage, premium report modules, API access keys) are non-refundable once activated.
• If an add-on feature is found to be defective or non-functional at the time of purchase, Own Education Own Career will provide a full refund or a replacement credit within 5 business days of a verified complaint.
• Setup fees and onboarding service charges are non-refundable once the onboarding session has commenced.

Non-Refundable Circumstances

Refunds will not be granted in any of the following circumstances:

• The refund request is made outside the applicable refund window specified above.
• The account has been suspended or terminated due to a violation of these Terms & Conditions.
• The User claims inability to use the Platform due to their own hardware, software, or internet connectivity issues.
• The User has already received a refund for the same purchase on a prior occasion.
• The purchase was made using promotional credits, discount codes, or complimentary trial offers.
• Partial use of a course, module, or feature has occurred beyond the thresholds stated in this policy.

Refund Process & Timeline

• Step 1 — Submit Request: Email oeoc.care@gmail.com with your registered email address, order/invoice number, reason for the refund request, and any supporting evidence
• Step 2 — Review: Own Education Own Career will acknowledge your request within 2 business days and complete its review within 7 business days of receipt.
• Step 3 — Decision: You will be notified of the outcome via email. Approved refunds will be processed within 5–10 business days of approval.
• Step 4 — Credit: Refunds are credited to the original payment method (credit/debit card, UPI, net banking, etc.). Own Education Own Career does not issue refunds in cash or via alternative payment methods.

Please note that your bank or payment provider may take additional time to reflect the credit in your account. Own Education Own Career is not responsible for delays caused by third-party financial institutions.

Chargebacks & Disputes

If you initiate a chargeback with your bank or payment provider without first contacting Own Education Own Career, we reserve the right to:

• Immediately suspend your account pending investigation.
• Contest the chargeback with documentary evidence of service delivery.
• Permanently terminate your account if the chargeback is found to be unwarranted.

We strongly encourage Users to contact our support team at oeoc.care@gmail.com before raising any dispute with their payment provider, as most issues can be resolved promptly through direct communication.

Consumer Rights

Nothing in this Return & Refund Policy shall limit or exclude any rights you may have as a consumer under the Consumer Protection Act, 2019 (India) or any other applicable consumer protection legislation. If you believe your statutory rights have been violated, you may file a complaint with the appropriate Consumer Disputes Redressal Commission or contact the National Consumer Helpline at 1800-11-4000.
